Team 5 Hour Sweepstakes Official Rules - Consumers

No Purchase Necessary to play or to win a prize.

  1. HOW IT WORKS: From 02/20/2008 through 11/30/2008, (the "Sweepstakes Period"), participants may visit www.Team5Hour.com, the promotion website of Innovation Ventures, LLC. ("Sponsor") to register for the sweepstakes, obtain cases or bottles of Sponsor’s 5-Hour Energy Drink products ("Products") and receive a chance to win one of the prizes specified below.
  2. ELIGIBILITY: Open to legal residents of the continental United States who are 18 years of age or older at time of entry. Void where prohibited by law. Employees of Sponsor, its parents, affiliates and subsidiaries, participating advertising and promotion agencies and prize suppliers (and members of their immediate family and/or those living in the same of household of each) are not eligible. Participants earn one entry in the sweepstakes for every five (5) points earned as herein described.
  3. HOW TO PLAY (Consumer): From 02/20/2008 through 11/30/2008, an individual consumer ("Consumer"), whether or not recruited by a fitness professional designated by Sponsor ("Pro"), may visit www.Team5Hour.com and register as directed at no cost and receive a user name and password. The first 5000 registered Consumers will also receive a free sample bottle of Product. The Consumer will receive five (5) points just for registering and may complete an online survey for an additional forty-five (45) points. Thereafter, a Consumer who purchases Products may send the following: a voucher obtainable online at www.Team5Hour.com and the purchase receipt and the wrapper from one bottle of Product containing the UPC, to "Five Hour Energy Drink Promotion", P.O. Box 165003, Columbus, Ohio 43216-5003, in order to receive one hundred (100) points, except for the first such purchase made by a Consumer in which case said Consumer shall earn twenty-five (25) additional bonus points. Each Consumer may only earn a maximum of one hundred (100) points per day using this method. A Consumer may also earn points by referring other Consumers to register as described above. For each referred Consumer who subsequently registers via the link provided in the referral, said recruiting Consumer shall receive an additional ten (10) points. Consumer will only earn points in the manner herein described for a maximum of five (5) referrals for the entirety of the promotion.
  4. TO OBTAIN POINTS WITHOUT PURCHASE: Send a self addressed stamped envelope along with a 3.5"x 5" card with participant’s legibly hand written name, complete address including zip code (no P.O. boxes), daytime telephone number with area code, email address, and date of birth to: Team 5 Hour Sweepstakes, Points Request, P.O. Box 165003, Columbus, Ohio 43216-5003. Requests must be postmarked by 11/30/08 and received by 12/8/08. For each request received during the Sweepstakes Period, one hundred (100) points will be awarded. Limit one request per outer-mailing envelope and limit one (1) request per household per postmarked day. Sponsors are not responsible for lost, ineligible, incomplete, late, postage-due or misdirected mail. No facsimile, photocopies or other mechanically reproduced requests will be honored.
  5. DRAWING: On or about 12/15/08, Sponsor will randomly select one winner from all eligible entries received (based on points earned throughout the Sweepstakes Period, as described above). The potential winner is subject to verification of eligibility and compliance with the promotion rules before the prize will be awarded. All taxes and expenses not stated on any prize are the sole responsibility of the winner. If claimed, the prize will be awarded.
  6. CONDITIONS OF PARTICIPATION: Points not legitimately obtained in accordance with these rules are void. No transfer, assignment or substitution of a prize will be permitted, except Sponsor reserves the right to substitute a prize for an item of equal or greater value in the event an advertised prize, or portion of the prize, is unavailable. All federal, state and local laws and regulations apply. Participants agree to be bound by the terms of these Official Rules and by the decisions of Sponsor, which are final and binding on all matters pertaining to this Sweepstakes. Each winner may be required to sign and return an Affidavit of Eligibility, a Liability Release and where legally permissible a Publicity Release within seven (7) business days following the date of notification. Failure to comply with this deadline may result in forfeiture of the prize. Return of any prize as undeliverable may result in disqualification. Acceptance of a prize constitutes permission for Sponsor and its agencies to use winner’s name and/or likeness for advertising and promotional purposes without additional compensation, unless prohibited by law.
  7. PRIZES AND APPROXIMATE RETAIL VALUES: One (1) Grand Prize is available to be won. The Grand Prize will consist of a trip for two to any SCW MANIA Event in 2009, including round-trip coach class airfare from a major airport of Sponsor’s choosing in the vicinity of winner’s residence, a three night stay (one room, double occupancy) at the SCW MANIA host hotel, registration in the SCW workshop events, $500 spending money, and a one year supply (365 bottles) of 5-Hour Energy Drink. ARV of each Grand Prize: $3,500 (actual value may vary based on timing of trip and location of winner’s residence). Odds of winning a Grand Prize depend on the number of entries received. All trips subject to availability. All trip arrangements will be made by Sponsor. Meal, gratuities and other expenses not specified are the sole responsibility of winners. Each travel companion must sign a liability/publicity release prior to travel.
  8. INDEMNIFICATION: By participating, participants agree to release, discharge, indemnify and hold harmless Sponsor and each of its respective officers, directors, employees, representatives, agents, advertising and promotional agencies from and against any claims made by winners, entrants, or any other third parties, related in any way to the operation of this Promotion as well as any other claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in any Promotion-related activity or participation in this Promotion or use or misuse of Products.
  9. INTERNET: In the event of a dispute as to any registration, the authorized account holder of the email address used to register will be deemed to be the registrant. The "authorized account holder" is the natural person assigned an email address by an internet service provider or other entity responsible for assigning email addresses for the service provider. Potential winners may be required to show proof of being the authorized account holder. Sponsor is not responsible for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive information by Sponsor on account of technical problems or traffic congestion on the Internet or at any Web site or any combination thereof. If for any reason the Promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes, technological or otherwise, which corrupt, disrupt or otherwise affect the administration, security, fairness, integrity, or proper conduct of this Promotion, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend any and all aspects of the Promotion. Sponsor reserves the right, but not the obligation, to select winners from eligible entries received as of the termination date. Sponsor further reserves the right to disqualify any individual who tampers with the entry process. Caution: Any attempt by any individual to deliberately damage any Web site or undermine the legitimate operation of the Promotion is a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such individual to the fullest extent of the law.
  10. WINNER’S LIST: For a winner’s list, send a separate self-addressed, stamped envelope to: 5-Hour Energy Winners List, P.O. Box 165003, Columbus, Ohio 43216-5003. Requests must be received by 09/30/08.
